Welcome to Stackd, https://teamstackd.com (the “Website”). This Terms of Use Agreement (the “Agreement”) is made and entered into by and between you and Stackd (“Company,” “we,” “us,” or “our”). This Agreement governs your use of and access to the Website and any products, services, templates, automations, or support offered through the Website (collectively, the “Services”).

Acceptance of This Agreement

By accessing or using the Services (or by clicking “accept” when prompted), you agree to be bound by this Agreement on behalf of yourself or your organization. If you do not agree, you may not use or access the Services and must exit the Website immediately.

Eligibility Requirements

Access & Account Responsibilities

You may be required to register an account to access certain features. You agree to provide accurate, current information and to safeguard your login credentials. You are responsible for all activity under your account. Stackd may suspend or terminate access for violations of this Agreement.

Permitted & Prohibited Uses

You agree to use the Services only for lawful purposes. Prohibited actions include:

  • Violating any law or third-party rights

  • Impersonating others or submitting false data

  • Disrupting or harming system performance

  • Attempting to reverse-engineer or access unauthorized areas

  • Uploading malware or scraping content

  • Misusing affiliate or referral systems

  • Harassing or interfering with other users

Subscription & Payment Terms

Order Submission: When you submit an order, you agree to pay the listed price, taxes, and any applicable fees.

Payment Methods: We accept payments via third-party processors. Stackd does not store your payment details.

No Access Until Payment: You will not receive access to paid services until full payment is received.

Subscription Terms:

  • Subscriptions begin upon successful payment

  • Fixed-term subscriptions expire unless renewed

  • Auto-renewal applies unless cancelled in advance

  • You can cancel subscriptions by emailing us at hello@teamstackd.com

Intellectual Property

All content, branding, software, documentation, and designs are owned by Stackd or our licensors. You are granted a non-transferable, limited license to use the Services for business purposes. You may not copy, reproduce, modify, sublicense, or exploit the content without written permission.

User-Generated Content

If you post or upload any content (e.g., feedback, testimonials, submissions), you grant Stackd a worldwide, perpetual license to use, share, and display it. You are solely responsible for your content and agree not to post anything unlawful, infringing, or harmful.

Assumption of Risk

Termination

We may suspend or terminate your access at any time for violations of this Agreement. Upon termination, your access ends immediately. You remain responsible for prior obligations and outstanding payments.

No Warranty

Services are provided “as is” and “as available” without warranties. We disclaim all express and implied warranties including merchantability and fitness for a particular purpose. Stackd is not liable for service interruptions, third-party content, or user reliance.

Limitation of Liability

To the fullest extent allowed by law, Stackd shall not be liable for indirect, incidental, punitive, or consequential damages. Your sole remedy for dissatisfaction is to stop using the Services.

Indemnification

You agree to defend, indemnify, and hold Stackd harmless from any claims, losses, liabilities, or costs arising from your use of the Services, your content, or your violation of this Agreement.

Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Oregon. Any disputes shall be resolved via arbitration in Portland, Oregon, or in courts located in Denver, Colorado, at our discretion. You waive any right to a class action or jury trial.

Time Limit to File Claims

You must bring any claim within one (1) year of the incident or your claim is permanently barred.

Miscellaneous

  • No Waiver: Failure to enforce any provision is not a waiver.

  • Severability: If any part is invalid, the rest remains in effect.

  • Entire Agreement: This is the entire agreement between you and Stackd.

  • No Partnership: This Agreement does not create a joint venture or partnership.

  • Export Compliance: You agree to comply with all applicable U.S. export laws.
